Shakhtar intends to sue FIFA over the departure of foreign players.
According to The Athletic, Shakhtar has submitted documents to CAS to appeal FIFA`s decision, which allows foreign players to unilaterally suspend their contracts.
The dispute between the parties arose after a FIFA decision was announced on June 21, according to which foreign players and coaches have the right to suspend their contracts with Ukrainian clubs until June 30, 2023, if by June 30 of the current year there is no agreement between the player or coach and their cluba mutual agreement will be reached.
Shakhtar hoped that it would be able to agree on the transfer value of the players and was actively negotiating several sales. In particular, negotiations were held with Fulham for striker Manor Solomon, but after FIFA`s decision they fell through.
The FIFA ruling meant Shakhtar had just over a week to complete the sales, while the buying clubs and players` agents knew they could simply wait until June 30 and not pay the club.
The miner suffered 40 million euros in direct losses and up to 50 million euros in total. The club`s appeal demands that FIFA`s decision be overturned, as well as requiring FIFA to compensate the club for damages.
The statement also demands that FIFA cover all costs associated with the arbitration proceedings, in addition to Shakhtar`s legal costs.
The club`s general director, Sergei Palkin, said that Shakhtar owes other clubs about 37 million euros and is demanding compensation from FIFA for losses incurred in the summer.
Clubs will start demanding all our debts, and I don`t know how to pay off these debts if I can`t sell players. This is the biggest problem. I have a problem with one club, and I believe that others will appear, " Palkin said.
Shakhtar`s lawyers argue that under Ukrainian and Swiss law there are no legal grounds for suspending employment contracts, and that FIFA should not interfere in contractual relations to which it is not a party.
They will also allege a possible breach of EU antitrust law, arguing that FIFA`s decisions have restricted Ukrainian clubs analyzed by
contacts with soccer tips ` access to the European market for player transfers.
